Utah Admin. Code R590-206-14 - Limits on Sharing Account Number Information for Marketing Purposes
(1) A licensee may not, directly or through
an affiliate, disclose a consumer's policy number or similar access number or
access code to a nonaffiliated third party for use in telemarketing, direct
mail marketing, or other marketing through electronic mail.
(2) Subsection (1) does not apply if a
licensee discloses a policy number or similar access number or access code to:
(a) a service provider to perform marketing
for a licensee's product or service, if the service provider is not authorized
to directly initiate charges to the account;
(b) a producer to perform marketing for a
licensee's product or service; or
(c) a participant in an affinity or similar
program if the participant in the program is identified to the customer when
the customer enters into the program.
