Utah Admin. Code R590-70-21 - Adequacy of Surplus
(1) In determining
the adequacy and reasonableness of an insurer's surplus, the commissioner will
consider the net effect of the factors set forth in Subsection
31A-16-106(4)
and any other factors that, alone or in combination, bear upon the insurer's
financial condition .
(2) In
comparing the surplus maintained by other insurers, the commissioner will
consider the extent to which each factor set forth in Subsection
31A-16-106(4)
varies from company to company .
(3) In determining the quality and liquidity
of an insurer's investments in subsidiaries, the commissioner will consider the
individual subsidiary and may discount or disallow the subsidiary's valuation
if warranted by the individual investments .
