Utah Admin. Code R608-1-14 - Representation of Complainants
A. If
a respondent has requested de novo review of the Director's Determination, the
Commission shall consider whether the Determination is supported by substantial
evidence.
B. If the Commission
concludes the Determination is supported by substantial evidence, the
Commission shall provide legal representation to support the Determination in
the de novo review proceeding.
C.
If the Commission concludes the Determination is not supported by substantial
evidence, the Commission shall not provide legal representation to support the
Determination in the de novo review proceeding.
D. The Commission shall notify the parties of
its conclusion regarding the existence or nonexistence of substantial evidence
to support the Director's Determination within twenty days from the date the
respondent files a request for de novo review.
E. The Commission's conclusion regarding the
existence or nonexistence of substantial evidence to support the Director's
Determination is not subject to further agency or judicial review.
