Utah Admin. Code R652-20-3000 - Mineral Lease Application-Lake or Stream Bed
1. Applications for mineral leases for lands
within the bed of a lake or stream will be rejected unless:
(a) the lake or stream has been judicially
determined to have been navigable at the time of statehood or was, in the
reasonable judgment of the division, navigable at the time; or
(b) the issuance to applicant of a lease on
the navigable lake or navigable stream bed would serve to protect the applicant
as the owner, or holder of mineral rights, on abutting riparian
uplands.
2. Any lessee
or operator proposing, or conducting, exploration or mining operations in the
bed of a navigable lake or stream shall, prior to the commencement of
operations, file the notification and obtain such permits as may legally be
required by any and all local, state, or federal governmental agencies, having
jurisdiction over these activities. In no event will the lessee or operator
cause pollution or salinity in any navigable lake or stream to exceed these
limits which are set by ordinance, law or inter-governmental treaty.
