Utah Admin. Code R652-21-601 - Statement of Public Interest and Establishment of Multiple Mineral Development Principles
Pursuant to Section 65A-17-303 and as the executive management authority over the state's sovereign lands under Section 65A-10-1, the division declares it is in the public interest to foster, encourage, promote, and balance the responsible development, production, and utilization of Great Salt Lake Elements or Minerals in such a manner as to:
(1) prevent Waste from arising from
concurrent extractive operations;
(2) ensure the greatest ultimate recovery of
Great Salt Lake Elements or Minerals is obtained without unduly interfering
with other concurrent extractive operations;
(3) establish the equal dignity of rights to
the Common Source of Supply while protecting the Correlative Rights of all
owners having rights to the Common Source of Supply and preserving the state's
fiduciary obligation to manage public trust assets; and
(4) encourage Emergent Technologies to
protect Great Salt Lake's overall ecological integrity while simultaneously
ensuring the greatest possible economic recovery for Great Salt Lake Operators
and the State.
