Utah Admin. Code R671-103-1 - Attorneys
(1) Only persons licensed to practice law in
the Utah may appear and represent an inmate, offender, or petitioner before the
Board, except as otherwise provided in statute.
(2) A person may not act as an attorney or
represent any inmate, offender, or petitioner before the Board if:
(a) the person has been prohibited from doing
so by Board order entered pursuant to the Board's inherent powers or this rule;
or
(b) the person is disbarred or
suspended from the practice of law in Utah or any other jurisdiction.
(3) An attorney may not represent
anyone in connection with a matter in which the attorney participated
personally and substantially as a judge or other adjudicative officer or law
clerk to such a person, or as an arbitrator, mediator or other third party
neutral unless all parties to the matter give informed consent.
(4) An attorney who has formally served as a
public officer or employee of the government shall not otherwise represent a
client in connection with a matter in which the attorney participated
personally and substantially as a public officer or employee, unless the
appropriate government agency gives its informed consent, confirmed in writing,
to the representation.
