Utah Admin. Code R82-3-101 - Definitions
As used in this part:
(1) "Decision Officer" means a person who has
been appointed by the Commission or the director of the Department of Alcoholic
Beverage Services to preside over the prehearing phase of all disciplinary
actions, and, in all cases not requiring an evidentiary hearing.
(2) "Disciplinary Action" means the process
by which violations of the Act and these rules are charged and adjudicated, and
by which administrative penalties are imposed.
(3) "Hearing Officer" means a person who has
been appointed by the Commission or the director to preside over evidentiary
hearings in disciplinary actions, and who is authorized to issue written
findings of fact, conclusions of law, and recommendations to the Commission for
final action.
(4) "Letter of
Admonishment" is a written warning issued by a decision officer to a respondent
who is alleged to have violated the Act or these rules.
(5) "Respondent" means a Department licensee,
or permittee, or employee or agent of a licensee or permittee, or other entity
against whom a letter of admonishment or notice of agency action is
directed.
(6) "Violation Report"
means a written report from any law enforcement agency or authorized Department
staff member alleging a violation of the Alcoholic Beverage Control Act or
rules of the Commission by a Department licensee, or permittee, or employee or
agent of a licensee or permittee or other entity.
