The Department of Transportation makes this rule pursuant to
Sections
72-5-111,
7 2-5-117,
72-5-404,
78B-6-520.3,
and
78B-6-521,
which authorize the executive director to prescribe the terms and conditions
for the sale or exchange of surplus right of way, and to make rules to ensure
that the value of the real property is consistent with the proposed price and
other terms of the purchase, sale, or exchange. Property or property interests
that involve federal requirements must be sold or exchanged in accordance with
the requirements of
23
C.F.R. Section 710.409.
