Utah Admin. Code R926-3-1 - Authority and Purpose
(1) Authority.
Section 72-2-109 directs the Utah
Department of Transportation, in cooperation with the governing bodies of
Utah's counties and municipalities, to make administrative rules providing for
uniform accounting of funds to be expended upon class B or class C roads as
required by the federal government under United States Code, Title 23, relating
to federal aid for highway purposes.
(a)
Section 72-3-103 authorizes Utah counties
to spend funds allocated from the Transportation Fund under rules made by the
Department to construct and maintain class B roads in each county.
(b) Section
72-3-104 authorizes Utah
municipalities to spend funds allocated to them from the Transportation Fund
under rules made by the Department to construct and maintain class C roads
within the corporate limits of each municipality.
(c) Subsection
72-2-110(2)
allows counties and municipalities to use some class B and class C road funds
to maintain class D roads.
(2) Purpose. This rule creates an
administrative structure that provides uniform accounting of funds the
Department allocates to counties and municipalities to build and maintain class
B or class C roads or maintain class D roads.
