Utah Admin. Code R982-111-315 - Rescheduling or Continuance of Hearing
(1) An ALJ may adjourn, reschedule, continue,
or reopen a hearing on the ALJ's own motion or on the motion of a
party.
(2)
(a) If a party knows in advance of the
hearing that the party cannot proceed with or participate in the hearing on the
date or time scheduled, the party must request that the hearing be rescheduled
or continued to another day or time.
(b) If a party submits a request for
rescheduling under Subsection (2)(a) after the hearing begins, the party must
show cause for failing to make a timely request.
(c) A party must call the division to request
rescheduling under Subsection (2)(a).
(d) A party making a request for rescheduling
or a continuance under Subsection (2)(a) must provide evidence of good cause
for the request.
(3) An
ALJ may not grant a party more than one request for a continuance under
Subsection (2)(a) absent compelling circumstances.
