Utah Admin. Code R986-100-116 - Overpayments
(1) A client is
responsible for repaying any overpayment for any program listed in
R986-100-102 regardless of who
was at fault in creating the overpayment.
(2) Underpayments may be used to offset an
overpayment for the same program.
(3) If a change is not reported as required
by R986-100-113 it may result in an
overpayment.
(4) The Department
will collect overpayments for all programs listed in
R986-100-102 as provided by
federal regulation for SNAP unless otherwise noted in this rule or inconsistent
with federal regulations specific to those other programs.
(5) This rule and
R986-100-117 to -135 apply to
overpayments determined under contract with the Department of Health unless a
Department of Health rule states otherwise.
(6) If an obligor has more than one
overpayment account and does not tell the Department which account to credit,
the Department will make that determination.
