Utah Admin. Code R986-100-135 - Further Appeal From the Decision of the ALJ or Hearing Officer
(1) Except as
provided in Section R986-100-138, each party has the
option of appealing the decision of the ALJ or hearing officer to either
(a) the Executive Director or person
designated by the Executive Director; or
(b) the District Court.
(2) An appeal must be filed, in writing,
within 30 days of the issuance of the decision of the ALJ or hearing officer.
An untimely request for agency review will be dismissed unless the requesting
party can show good cause for the untimely request pursuant to Subsection
R986-100-131(2).
(3) Pursuant to Section
63G-4-402, within 30 days of the
date an agency review decision is issued, an adversely affected party may file
a petition for judicial review with the district court.
