Utah Admin. Code R988-500-6 - Location, Establishment, and Operation of Temporary Overflow Shelter
(1) When
contracting with an entity for the operation of a temporary overflow shelter as
permitted by Section
35A-16-502.5, the office shall
first try to contract with a non-profit entity. If the office cannot contract
with a non-profit entity, the office shall contract with a local government
entity associated with the municipality or county in which the temporary
overflow shelter is located. If the office cannot contract with either a
non-profit entity or a local government entity, other qualified entities shall
be considered.
(2) When determining
the location of a temporary overflow shelter, the office shall consult with the
Utah Homeless Network steering committee and the local homeless council ("LHC")
with jurisdiction over the applicable municipality or county. The office shall
give preference to sites with adequate access to transportation, food, and
services, as determined in the office's sole discretion. The office shall also,
in conjunction with the LHC, determine an overflow shelter's capacity. All
other factors being equal in the office's sole discretion, the office shall
give preference to the shelter with the most capacity.
