Utah Admin. Code R990-300-7 - Cure Period
(1) A reporting
entity has no more than 90 calendar days after the day on which the notice of
noncompliance is sent to cure deficiencies in the submitted moderate income
housing report.
(2) If a deficiency
described in the notice of noncompliance requires the reporting entity to make
a legislative change and the reporting entity does not pursue the first appeal
opportunity, the legislative change must be completed by the legislative body
and become effective within the 90-day cure period to cure the
deficiency.
(3) If the reporting
entity does not cure a deficiency within the 90-day period, the reporting
entity will be ineligible for funding as provided in Sections
10-9a-408 and
17-27a-408.
(4) If a reporting entity submits corrections
to cure deficiencies and the division determines the report remains
noncompliant, the reporting entity may request an appeal.
