Utah Admin. Code R994-406-402 - Burden and Standard of Proof in Fraud Cases
(1) The Department has the burden of proving
each element of fraud.
(2) The
elements of fraud must be established by clear and convincing evidence. There
does not have to be an admission or direct proof of intent.
