Utah Admin. Code R994-508-116 - Rescheduling or Continuance of Hearing
(1) The ALJ may adjourn, reschedule,
continue, or reopen a hearing on the ALJ's own motion or on the motion of a
party.
(2) If a party knows in
advance of the hearing that they will be unable to proceed with or participate
in the hearing on the date or time scheduled, the party must request that the
hearing be rescheduled or continued to another day or time.
(a) The request must be received prior to the
hearing.
(b) The request must be
made orally by calling the Appeals Unit. If the request is not received prior
to the hearing, the party must show cause for failing to make a timely
request.
(c) The party making the
request must provide evidence of good cause for the request.
(3) Unless compelling reasons
exist, a party will not normally be granted more than one request for a
continuance.
