AGENCY SUMMARY
The State Air Pollution Control Board is authorized to make regulations for the control and abatement of air pollution throughout the Commonwealth or in affected areas. It may grant local variances and issue orders for the control and abatement of air pollution and for the enforcement of its regulations. It may make regulations for the determination of a formula for the basis of any noncompliance penalty to be assessed by a court. It may issue permits for the construction or modification and operation of polluting facilities and collect fees for the administrative and enforcement costs of such permits for major facilities. Enactment of local air pollution control ordinances is subject to its approval. The board may promulgate regulations to provide for emissions trading programs to achieve and maintain the national Ambient Air Quality Standards established by the U.S. Environmental Protection Agency. Code of Virginia, Title 10.1, Chapter 13. The board is authorized to adopt rules and regulations that include (i) standards and procedures for the conduct of mediation and dispute resolution; (ii) the appointment and function of a neutral to encourage and assist parties to voluntarily compromise or settle contested issues; and (iii) procedures to protect the confidentiality of papers, work product or other materials. Code of Virginia, Title 10.1, Chapter 11.1, Article 1.
The board is required to promulgate regulations governing the permitting of infectious waste incinerators. Chapters 751, 773, and 774 of the 1992 Acts of Assembly.
The board also may adopt emissions standards for motor vehicles in certain localities, make regulations fixing standards and procedures for the inspection of motor vehicles, and approve training programs for inspectors. It may license both stations qualified to do safety inspections and fleet owners or lessees to conduct emissions inspections. It licenses persons as emissions mechanics/inspectors. It may also adopt clean alternative fuel fleet standards for motor vehicles. Code of Virginia, Title 46.2, Chapter 10, Article 22.
