(1) When a public
water system or operator fails to comply with the requirements of this chapter,
the department may initiate appropriate enforcement actions as authorized in
chapters 70A.120 and 70A.125 RCW.
(2) The department's enforcement actions
against a public water system or operator may include one or more of the
following:
(a) Issuing an informal letter
directing appropriate corrective measures;
(b) Issuing a notice of violation requiring
appropriate corrective measures;
(c) Issuing a compliance schedule of specific
actions needed to achieve compliance;
(d) Issuing an order requiring specific
actions or ceasing unacceptable activities within a designated time
period;
(e) Imposing civil
penalties for up to:
(i) Five thousand dollars
per day per violation; or
(ii) Ten
thousand dollars per day per violation in the case of a violation that the
department has determined to be a public health emergency;
(f) Revoking or suspending a certification in
accordance with WAC
246-292-100; and
(g) Other legal action by the attorney
general or local prosecutor.
