Wash. Admin. Code § 296-127-210 - Suit against retainage and bonds
(1) If the director issues a final decision
that includes a finding that the contractor has violated
RCW
39.12.065 or
39.12.050, and the finding is not
timely appealed or is affirmed by the courts, the department may file suit
against the appropriate retainage and bonds to recover the amount of unpaid
prevailing wages or the civil penalty.
(2) The department may, before issuance of a
final decision, file suit against the appropriate retainage and bonds to
recover unpaid prevailing wages if the filing of a suit is necessary to
preserve the claim. The suit shall be held in abeyance pending the exhaustion
of administrative remedies.
