W. Va. Code R. § 61-12I-5 - Hearings and Penalties
5.1. The
commissioner shall be governed by W. Va. Code '19-16A-22
when conducting hearings or assessing civil penalties for the violation of
these rules. The penalty provisions of W. Va. Code '19-16A does not preclude
the commissioner's right to issue orders or assess penalties pursuant to W. Va.
Code '22-12-1 et
seq.
