W. Va. Code R. § 91-2-3 - Licensing or Registration Instructions
3.1. Every Motor Vehicle, trailer,
semi-trailer and pole trailer when driven or moved upon a highway, shall be
subject to the registration and certificate of title provisions of Chapter
Seventeen-A of the Motor Vehicles Laws of this State, except as provided in
Section Two, Article Three.
3.2.
When application for certificate of title and license plates are made at the
same time, no form of application for license is required. However, the license
fee should accompany the application for certificate of title. If no fee is
submitted for license, and the certificate of title is issued, an application
for license will be mailed to the registered owner. In the event that no
application is available for a vehicle that an applicant desires to license,
and the vehicle is properly registered in the applicant' name in this State,
the applicant may submit the required fee and a complete description of the
vehicle for which application for license is being made. The description should
include the manufacturer's made and serial number, year model, body style, West
Virginia Certificate of Title Number, and the name and mailing address of the
registered owner. Department form number forty-four is available and may be
used for this type of application. A Schedule of Fees for all classes of
License is available to the public upon request.
3.3. Where application for registration is
made between the first day of October and the thirty-first day of December,
inclusive, in any fiscal year, the fee shall be for three-quarters of the
annual fee. When application is made between the first day of January and the
thirty-first day of March, inclusive, in any fiscal year, the fee shall be for
one-half the annual fee. When application is made between the first day of
April and the thirteenth day of June, inclusive, in any fiscal year, the fee
will be for one-fourth (1/4) the annual fee. If additional weight or fees are
required, the quarterly reduction in fees would apply to all applications for
transfer of license, additional weight, and exchange of license from one class
to another.
3.4. Where application
is made to transfer license from one vehicle to another, or to exchange license
from one class to another, the following requirements should be complied with
and the necessary fees and registration card submitted with the application:
(a) The name of the applicant must be the
same as shown on the vehicle from which the exchange or transfer is being made.
License cannot be transferred or exchanged from one person to another, except
to a legal heir as provided in Chapter Seventeen-A, Article Four, Section Five,
of the Code of West Virginia.
(b) A
fee of one dollar is required to transfer license from one vehicle to another,
plus the difference in fee if transfer is from a vehicle in a low weight
bracket to a vehicle in a higher weight bracket. A fee of one dollar would also
be required to transfer registration to a legal heir.
(c) When application is made to exchange
license from one class to another, the applicant is required to surrender the
license plate and registration card he desires to exchange. A one dollar
exchange fee would be required, and any additional fee necessary to equalize
the value of the plate surrendered with the value of the registration plate
desired. The required class of license plate and registration card will be
issued for the vehicle the exchange was made to.
