W. Va. Code R. § 64-3-5 - [Effective 7/1/2025] Permit to Operate a Public Water System
5.1. A public water system shall be operated
in accordance with this rule and the federal regulations adopted in this
rule.
5.2. The commissioner will
develop a program for the issuance of a permit to operate a public water
system. The permit is renewable annually and may be revoked for failure to
comply with the requirements of this rule or the federal standards adopted in
this rule. The commissioner will administer the permit program uniformly and
will not grant a permit until after he or she has completed a sanitary
survey.
5.3. In the event of a
proposed change in the ownership of a public water system, the new owner shall
submit a written application to the commissioner at least 15 working days
before the proposed change to transfer the permit to operate.
5.4. The current permit to operate shall be
posted in a conspicuous place at the public water system's treatment plant or
main office.
