027-3 Wyo. Code R. §§ 3-9 - Bidder prequalification for competitive sealed bidding
(a) In a competitive sealed bidding process,
a procuring agency may, at its discretion, require all potential bidders to
submit applications for prequalification prior to submitting bids on a
project.
(b) Prequalification does
not replace the use of evaluation criteria as allowed in Section
20(a) of this rule. A
procuring agency may use prequalification in conjunction with the evaluation
criteria even after prequalification has been completed.
(c) A call for prequalification applications
shall be advertised, at a minimum, on the state procurement website for not
less than two (2) consecutive weeks.
(d) To the extent applicable, based on the
scope of work requested in the call for prequalification applications, an
application for prequalification shall include, at a minimum:
(i) A signed affidavit stating the
applicant's willingness to comply with applicable laws and policies, which may
or may not be unique to the project or procuring agency;
(ii) Proof of equipment, certifications, or
experience specific to the scope of project work;
(iii) A workers compensation program
certificate of good standing from the Wyoming Department of Workforce
Services;
(iv) An unemployment
insurance program certificate of good standing from the Wyoming Department of
Workforce Services; and
(v) Proof
of the applicant's residency certification per
W.S.
16-6-102, if applicable.
