053-6 Wyo. Code R. §§ 6-17 - Enforcement
(a) Where
Labor Standards' investigation reveals a contractor's or subcontractor's
noncompliance with the provisions of the Prevailing Wage Act, Labor Standards
may:
(i) Consult with the noncompliant party
and allow for a reasonable opportunity to come into compliance; and
(ii) Direct the public entity letting the
contract, or the general contractor, to withhold further payment to the
noncompliant party until prevailing wages are paid, pursuant to Wyoming Statute
§ 16-6-117.
(b)
Where Labor Standards' investigation reveals a contractor's or subcontractor's
intentional and willful violation of the Prevailing Wage Act, or where a
noncompliant party fails to come into compliance, Labor Standards shall
petition the appropriate district court for enforcement the Prevailing Wage Act
and assessment of penalties as set forth in Wyoming Statute §
27-4-412.
