W.S. 48-8 - [Effective until 9/12/2025] Account Refunds

(a) All refunds to an account shall be credited directly back to the account. No account funds shall be refunded, rebated, or shared with a parent/guardian or student in any manner. All refunds shall be refunded within thirty (30) days of being notified of their obligation to refund.

(b) If account funds are used to make a partial payment to an education service provider to reserve an ESA student's enrollment and the ESA student does not enroll, the education service provider shall refund the payment back to the account within thirty (30) days after receiving notice that the ESA student will not enroll or after the educational program has started, whichever occurs first.

(c) The Department shall suspend payments to any ESP that has not refunded amounts due in accordance with time requirements provided in this section. ESP payment eligibility shall resume when the ESP makes all overdue refund payments.
