extenuating circumstances

Extenuating circumstances (also called mitigating factors) are the surrounding facts or details essential to fully understanding the context of a situation. With this additional context, the unlawful actions a person took may be interpreted as less severe, or that person’s culpability may be diminished. In a criminal trial, a showing of extenuating circumstances might result in a lesser charge or a reduction in punishment, such as a shorter sentence. In civil cases, extenuating circumstances may decrease the amount of damages awarded.

Conversely, aggravating factors may increase punishment in a criminal setting.
