As the Fourth Circuit Court of Appeals defined in U.S. v. Konstovich, recovery refers to the amount that a claimant may eventually receive under or in consequence of a judgment. In Long v. Farmers Insurance Company, the Oregon Supreme Court noted that recovery also means judgment, such as voluntary payments made in settlement, or the result of a court judgment. In Pulliam v. HNL Automotive Inc., the California Court of Appeals, Second District, Division Five ruled that recovery to a plaintiff could include an award of attorney fees.
