Article 21, § 9 of the South Dakota Constitution states that only a marriage between a man and a woman is valid or recognized in the state. It further bars recognition of civil unions, domestic partnerships, or other similar relationships involving two or more persons. This constitutional provision was invalidated by the U.S. Supreme Court in Obergefell v. Hodges, 576 U.S.
The Summary Jurisdiction (Offences) (Amendment) Act of 2021 repeals Section 153(1)(xlvii) of the Summary Jurisdiction (Offenses) Act, which had criminalized appearing in public while "cross-dressing for an improper purpose.” The repeal brings the statute into conformity with the Caribbean Court of Justice’s 2018 decision in Quincy McEwan et al v.
Women of Badi origin, an ethnic minority subjected to social and economic exclusion in Nepal, are often forced into prostitution and become single mothers. The petition sought to rectify the common practice of denying citizenship and other rights to Badi children when the father cannot be found. The Court ruled that it was unconstitutional to deny citizenship on such claims and, furthermore, amended a law that gave men precedence over women in birth and death registrations.
The applicant, a transgender man who was registered in the civil registry records as “female,” had applied to a Turkish Court for gender reassignment authorization in 2005. The first instance court and the appeal courts rejected his application on the grounds of not being permanently unable to procreate, and therefore not satisfying one of the requirements of Article 40 of the Turkish Civil Code.
