3 AAC 100.030 - Roles and responsibilities
(a) The board is
vested with and may exercise all of the rights, powers, and duties that relate
to the procurement of construction, supplies, services, and professional
services for the authority, and the control over construction, supplies,
services, and professional services for the authority.
(b) The board may delegate to the executive
director or other qualified employees of the authority any right, power, or
duty described in (a) of this section; however, the board retains the right,
power, and duty
(1) to consider appeals of
protests under

AAC 100.570; and
(2) to adopt, amend, or repeal regulations
under AS
36.30.015(f) and AS 44.62
(Administrative Procedure Act).
(c) Subject to a delegation of the authority
from the board, the executive director shall
(1) appoint a chief procurement officer for
the authority;
(2) take actions
necessary to provide a recommendation to the board on a protest appeal under

AAC 100.570;
(3) take actions necessary to resolve any
appeal of a contract claim under
3
AAC 100.590;
(4) subdelegate procurement authority to
qualified employees of the authority to carry out the purposes of this
chapter.
(d) Subject to
a delegation of the authority from the executive director, the chief
procurement officer of the authority shall
(1) procure or supervise the procurement of
all supplies, services, construction, and professional services needed by the
authority;
(2) prescribe the time,
manner, and form of making requisitions for supplies and services;
(3) sell, trade, transfer, or otherwise
dispose of surplus, obsolete, or unused supplies;
(4) prescribe standard forms for solicitation
documents and contracts; and
(5)
provide for other matters that may be necessary to carry out this
chapter.
(e) An employee
of the authority may exercise a delegated power only in accordance with the
delegation and this chapter. The delegation must be in writing and may be
revoked at any time, with or without cause, by the board, or in the case of a
delegation from the executive director, by the executive director.
