5 AAC 01.710 - Fishing seasons
(a) Except in the nonsubsistence areas
described in
5
AAC 99.010(a)(1) and (2) and unless
restricted in this section,
5
AAC 01.725, or under the terms of a subsistence
fishing permit, fish, other than rainbow trout and steelhead trout, may be
taken in the Southeastern Alaska Area at any time.
(b) Repealed 6/30/83.
(c) Herring may be taken at any time, except
that in the 72 hours before, and 72 hours after an open commercial herring
fishing period in the Southeastern Alaska Area, a vessel that, or crew member
or permit holder who, participates in that commercial herring fishery opening
may not take or possess herring under this chapter in any district in the
Southeastern Alaska Area.
(d)

(e) From July 7
through August 7, sockeye salmon may be taken in the waters of Klawock Harbor
enclosed by a line from the northernmost tip of Klawock Island at 55°
33.42' N. lat., 133° 06.38' W. long. to Klawock Island Light to the Klawock
Cannery Dock at 55° 33.47' N. lat., 133° 05.96' W. long., the Klawock
River, and Klawock Lake only from 8:00 a.m. Monday until 5:00 p.m.
Friday.
(f) A subsistence permit
issued under
5
AAC 01.015 for salmon taken in those waters of Sumner
Strait in the vicinity of Point Baker will specify the
(1) area where the salmon may be
taken;
(2) time period during which
the salmon may be taken; and
(3)
gillnet gear that may be used, not to exceed 50 fathoms in length.
(g) From December 1 through May
15, lingcod may not be taken with a spear or while using diving gear.

At its February 23 - 27, 1993 meeting, the Board of Fisheries readopted 5 AAC 01.710(c) - (e) in their entirety without change, under ch. 1, SSSLA 1992 (the 1992 subsistence law), which repealed and reenacted AS 16.05.258.
