Ariz. Admin. Code § R3-10-1702 - Withdrawal of Qualified Exemption; FDA
A. The FDA may withdraw a farm's qualified
exemption pursuant to 21 CFR 112(R) . For example, an exemption may be withdrawn
by FDA:
1. In the event of an active
investigation of a foodborne illness outbreak that is directly linked to the
farm.
2. If FDA determines that it
is necessary to protect the public health and prevent or mitigate a foodborne
illness outbreak based on conduct or conditions associated with the qualified
farm that are material to the safety of the food that would otherwise be
covered produce grown, harvested, packed or held at the
farm.
B. Requirements
regarding notice, appeals, hearings, timeframes, decisions, revocation and
reinstatement for an exemption withdrawn by FDA are governed by 21 CFR
112(R).
