Ariz. Admin. Code § R3-11-903 - Formal Hearing
A.If a
formal hearing under A.R.S. §
32-2234,
32-2249,
32-2274,
or
32-2294
is to be held before an administrative law judge, the requirements in A.R.S.
§
41-1092
through
41-1092.11
apply.
B.If a formal hearing under
A.R.S. §
32-2234,
32-2249,
32-2274,
or
32-2294
is to be held directly before the Board, the requirements in A.R.S. §
41-1092
through
41-1092.11
and the following apply:
1. The Board shall
provide a written complaint and notice of formal hearing to a licensee or
certificate holder at the licensee's or certificate holder's last known address
of record, by personal service or certified mail, return receipt requested at
least 30 days before the date set for the formal hearing;
2. A licensee or certificate holder served
with a complaint and notice of hearing shall file an answer by the date
specified in the notice of hearing admitting or denying the allegations in the
complaint;
3. A complaint and
notice of hearing may be amended at any time. The Board shall send written
notice of any changes in the complaint and notice of hearing to the licensee or
certificate holder at least 20 days before a formal hearing;
4. The licensee or certificate holder may
appear at the formal hearing with or without the assistance of an attorney. If
the licensee or certificate holder fails to appear, the Board may hold the
formal hearing in the licensee's or certificate holder's absence;
5. The Board may conduct a formal hearing
without adherence to the rules of procedure or rules of evidence used in civil
proceedings. At the formal hearing, the Board shall rule on the procedure to be
followed and admissibility of evidence; and
6. The Board shall send a written decision
that includes written findings of fact, conclusions of law, and order to the
licensee or certificate holder within 60 days after the formal hearing is
concluded. The licensee, certificate holder, or Board may seek rehearing or
review of the order according to A.A.C.
R3-11-904 or A.R.S. §
41-1092.02.
