Ariz. Admin. Code § R4-19-703 - Oral Proceedings
A. The
Board shall schedule an oral proceeding on all rulemakings and publish the
notice as prescribed in A.R.S. §
41-1023.
A Board member, the executive director, or a Board staff member shall serve as
presiding officer at an oral proceeding.
B. The Board shall record all oral
proceedings either by an electronic recording device or stenographically, and
any resulting cassette tapes or transcripts, registers, and all written
comments received shall become part of the official record.
C. The presiding officer shall conduct an
oral proceeding according to A.R.S. §
41-1023;
and
1. Request each person in attendance
register;
2. Obtain the following
information from any person who intends to speak:
a. Name and whether the person represents
another;
b. Position with regard to
the proposed rule; and
c.
Approximate length of time needed to speak;
3. Open the proceeding by identifying the
subject matter of the rules under consideration and the purpose of the
proceeding;
4. Present the
agenda;
5. Ensure that a Board
representative explains the background and general content of the proposed
rules;
6. Limit comments to a
reasonable period, and prevent undue repetition of comments;
7. Announce the address for written public
comments and the date and time for the close of record; and
8. Close the proceeding if there are no
persons in attendance within 15 minutes after the posted meeting
time.
