Ariz. Admin. Code § R6-13-133 - Overpayments: Date of Discovery; Collection
An overpayment exists when an assistance unit receives a TC payment that exceeds the amount the assistance unit was eligible to receive.
1. The Department shall
pursue collection of all overpayments under A.R.S. §
46-213.
2. The Department shall send the recipient a
notice of overpayment within 90 days of the date of discovery. The date of
discovery is the date the FAA has all of the information necessary to
accurately calculate a potential overpayment and writes an overpayment report
to the Department's Office of Accounts Receivable and Collections
(OARC).
3. If the FAA suspects that
fraudulent activity caused the overpayment, the FAA shall refer the potential
overpayment to the Department's Office of Special Investigations (OSI) for
further investigation and potential prosecution. The overpayment report may be
delayed pending the outcome of the OSI investigation.
4. The Department's failure to comply with
the time-frame in subsection (2) shall not affect the validity or collection of
the overpayment.
