Cal. Code Regs. Tit. 22, § 78401 - Licensee Responsibility
(a) Each licensee shall have legal
responsibility and administrative authority for operation of the
center.
(b) The licensee shall
exercise general supervision over the affairs of the center and establish
policies concerning its operation in conformance with these regulations and the
welfare of the participants it serves.
(c) Each licensee which is a corporation,
company, or partnership, shall be legally organized as follows:
(1) The governing board shall be active,
functioning and shall have regularly scheduled meetings.
(2) Minutes shall be kept of all board
meetings and shall be available for review by the Department.
(3) The board shall delegate to the
administrator the responsibility for administration of the center.
(4) A change in the chairman of the governing
board shall be reported to the Department in writing within 14 working days
following such change. Such notification shall include the name, address and
the Social Security number of the new principal officer.
(d) Each licensee which is a city or county
shall be designated by the appropriate governing body as a city or county
agency through which adult day health care shall be offered.
(e) When a county or city is planning to make
application to provide adult day health care, the city or the county shall file
with the Department a letter of intent or resolution signed by the chairman of
the Board of Supervisors or appropriate governing body authorizing the chairman
to sign the application and to enter into agreements with the
Department.
