Cal. Code Regs. Tit. 22, § 78405 - Composition of Governing Board
(a) The governing board of an adult day
health center shall have final authority and responsibility for the conduct of
the center.
(b) The board shall be
comprised of four or more persons, at least one-half of whom shall be:
(1) Recipients of the services of the adult
day health center.
(2) Relatives of
such recipients.
(3)
Representatives of community organizations with particular interest in programs
for the elderly.
(c) The
Department may grant exceptions to Section
78405(b) for an
applicant upon written request of the applicant as follows:
(1) The applicant may delegate primary
responsibility for supervision of its adult day health care program to a
special board which meets the compositional requirements of this section,
and
(2) Such special board reviews
and recommends to the governing board the budget, personnel and subcontractors
of the adult day health care program.
(d) No member of the governing or special
board or any immediate family thereof shall have any direct or indirect
interest in any contract for supplying services to the adult day health
center.
