Fla. Admin. Code Ann. R. 64B4-5.007 - Citations
(1) Definitions. As used in this rule:
(a) "Citation" means an instrument which
meets the requirements set forth in Section
456.077, F.S., and which is
served upon a subject for the purpose of assessing a penalty in an amount
established by this rule;
(b)
"Subject" means the licensee, registered intern, provisional licensee,
applicant, person, partnership, corporation, or other entity alleged to have
committed a violation designated in this rule.
(2) In lieu of the disciplinary procedures
contained in Section 456.073, F.S., the Department is
hereby authorized to dispose of any violation designated herein by issuing a
citation to the subject within six months after the filing of the complaint
which is the basis for the citation.
(3) The Board hereby designates as offenses
for citations and the appropriate penalties the following:
(a) Failure to make available to a patient or
client upon written request, reports, copies of test results, or documents in
the possession or under the control of the licensee, registered intern,
provisional licensee, or certificateholder which have been prepared for and
paid for by the patient or client - $500.
(b) Failure of any subject to inform the
Department within 30 days of any change of address of either a place of
practice or current mailing address - $500.
