Fla. Admin. Code Ann. R. 64F-17.003 - Governing Board
(1) The governing board
of institutions holding federal tax-exempt, not-for-profit status shall have a
majority of its members residents of the county in which the institution is
located.
(2) The board shall
establish in writing, the purpose or purposes for which the institution is
organized, and provisions for managing the business and regulating the affairs
of the institution. This written document shall be provided to the Department
of Health, Bureau of Child Care Nutrition Services, upon request.
(3) A majority of the board shall have no
direct or indirect financial interest in the activities of the institution nor
shall a majority of the board be related by blood or marriage to the
institution's personnel or to each other.
(4) No board member shall have been convicted
of or found guilty of, or entered a plea of nolo contendere to a felony in any
jurisdiction, regardless of adjudication.
(5) Board members shall not vote on decisions
regarding their own compensation or that of a related party.
(6) Minutes of board meetings shall be
recorded and, upon request, made available to the Department of Health, Bureau
of Child Care Nutrition Services, for review.
