Haw. Code R. § 11-280.1-110 - Reporting by owner or operator
(a) An owner or
operator must submit the appropriate forms listed in section
11-280.1-111(b)
documenting current evidence of financial responsibility to the director:
(1) Within thirty days after the owner or
operator identifies a release from an underground storage tank or tank system
required to be reported under section
11-280.1-53 or
11-280.1-61;
(2) If the owner or operator fails to obtain
alternate coverage as required by this subchapter, within thirty days after the
owner or operator receives notice of:
(A)
Commencement of a voluntary or involuntary proceeding under Title 11
(Bankruptcy), U.S. Code, naming a provider of financial assurance as a
debtor;
(B) Suspension or
revocation of the authority of a provider of financial assurance to issue a
financial assurance mechanism;
(C)
Failure of a guarantor to meet the requirements of the financial test;
or
(D) Other incapacity of a
provider of financial assurance; or
(b) An owner or operator must certify
compliance with the financial responsibility requirements of this subchapter as
specified in the notification form submitted pursuant to section
342L-30, Hawaii Revised
Statutes, or section
11-280.1-34, the permit
application submitted pursuant to section
11-280.1-324 or
11-280.1-326, and the
certification of installation form submitted pursuant to section
11-280.1-325(d).
(c) The director may require an owner or
operator to submit evidence of financial assurance as described in section
11-280.1-111(b)
or other information relevant to compliance with this subchapter at any
time.

(b) An owner or operator must certify compliance with the financial responsibility requirements of this subchapter as specified in the notification form submitted pursuant to section 342L-30, Hawaii Revised Statutes, section 11-280.1-34, or the permit applications under sections 11-280.1-324 and 11-280.1-326.
(c) The director may require an owner or operator to submit evidence of financial assurance as described in section 11-280.1-111(b) or other information relevant to compliance with this subchapter at any time.
