Haw. Code R. § 13-231-2 - Agreement for the use of small boat harbor property, facilities and offshore mooring areas
(a) Before any
property or facility at a small boat harbor or offshore mooring area is
utilized by any vessel, its owner shall comply with the following:
(1) Execute an agreement as set forth in
Exhibit "A", CONTENTS DESCRIPTION OF THE AGREEMENT OF BOATOWNER PURSUANT TO
SECTION 13-231-2 OF THE SMALL BOAT HARBORS REGULATIONS, INCLUDING OFFSHORE
MOORING dated July 2012, located at the end of this chapter; and incorporated
herein;
(2) Obtain the approval of
the department as evidenced by the chairperson's or the chairperson's
representative's signature on the agreement; and
(3) Be in compliance with all state and
federal laws and rules of the department.
(b) Nothing contained herein shall restrict
the department's power to waive the requirements of this section as the
circumstances may warrant.
(c) For
the purpose of this section, a lessee under a lease not intended as security is
not an "owner".
(d) Offshore
mooring rules and areas are described in chapter 13-235.
