560 IAC 2-6-10 - Mediation

Sec. 10.

(a) All mediations conducted under this article shall be confidential and subject to Rule 2 Mediation of the Indiana Rules for Alternative Dispute Resolution adopted by the Indiana supreme court, last amended on February 9, 2017, not including any subsequent amendments, which is incorporated in this article by reference and may be obtained from the Indiana supreme court online, except to the extent outlined in this article. All mediations shall be subject to Rule 2 of the Indiana Rules for Alternative Dispute Resolution, except to the extent such rule is inconsistent with this article.
(b) Mediators shall be appointed by the executive director from the board's staff or ad hoc panel.
(c) Mediators are not required to be registered mediators or attorneys.
(d) A mediator shall not be subject to process requiring the disclosure of any matter occurring during the mediation except in a separate matter as required by law.
(e) Mediation shall be regarded as settlement negotiations.
