Upon written request of a party or on its own motion, the
commissioner or designee may review an interlocutory order of the presiding
officer. In determining whether to do so, the commissioner or designee shall
weigh the extent to which granting the interlocutory appeal would expedite
final resolution of the case and the extent to which review of that
interlocutory order at the time the proposed decision of the presiding officer
is reviewed would provide an adequate remedy. Any request for interlocutory
review must be filed within 14 days of issuance of the challenged order, but no
later than the time for compliance with the order or the date of hearing,
whichever is first.
