(1)
Open records. Department records are open for public
inspection and copying unless otherwise provided by rule or law.
(2)
Confidential records.
Iowa Code chapters governing the operations of the department establish the
confidential nature of many department records. The department also administers
several federally funded programs and is authorized by Iowa Code section 22.9
to enforce confidentiality standards from federal law and regulation as
required for receipt of the funds where the department has determined that the
right to examine and copy public records under Iowa Code section
22.2 would cause the denial of
funds, services, or essential information from the United States government
that would otherwise be available to the department.
(3)
Authority to release confidential
records. The department may have discretion to disclose some
confidential records that are exempt from disclosure under Iowa Code section
22.7 or other provision of
law.
