Nev. Admin. Code § 686B.765 - Hearings to review filings: Review of disapproval by hearing officer

1. If proposed rates are disapproved by an order of the hearing officer:
(a) The insurer may request a hearing as provided in subsection 3 of NRS 686B.110; or
(b) The parties may, by stipulation, declare that a hearing held pursuant to NAC 686B.730 to 686B.765, inclusive, shall be deemed a hearing to determine the validity of the action as provided in subsection 3 of NRS 686B.110, in order to allow the insurer to seek judicial review of the order.
2. If the insurer requests a hearing as provided in subsection 3 of NRS 686B.110, the hearing must be conducted as a hearing de novo.
