Nev. Admin. Code § 704.8789 - System emergency
1. A qualifying
facility is required to provide energy or capacity to an electric utility
during a system emergency only to the extent:
(a) Provided by agreement between the
facility and the utility; or
(b)
Ordered by federal authority pursuant to the Federal Power Act (
16 U.S.C. §
824 a).
2. During any system emergency, an electric
utility may discontinue:
(a) Purchasing
electric energy from a qualifying facility if the purchases would aggravate the
emergency; and
(b) Selling electric
energy to a qualifying facility, if the discontinuance is
nondiscriminatory.
3. An
electric utility may make the final determination whether to buy electric
energy from or sell electric energy to a qualifying facility during a system
emergency.
