N.J. Admin. Code § 10:69-3.38 - Strikers
(a)
AFDC-related Medicaid benefits shall not be payable for any month in which any
caretaker relative with whom the child is living, is, on the last day of such
month, participating in a strike. Additionally, no individual's needs shall be
included in determining the amount of AFDC-related Medicaid payable for any
month to a family if, on the last day of the month, such individual is
participating in a strike.
1. The term
"strike" includes any strike or other concerted stoppage of work by employees
(including a stoppage by reason of expiration of a collective bargaining
agreement) and any concerted interruption of operations by employees.
2. The term "participating in a strike" means
an actual refusal in concert with others to provide services to one's
employers.
