Ohio Admin. Code 3745-580-01 - Scrap tire - applicability
(A)
Except as
provided in paragraph (D) of this rule, rules
3745-580-01 to 3745-580-99 of
the Administrative Code are applicable to any person who possesses, generates,
stores, transports, disposes, or beneficially uses scrap tires, and any person
who establishes, owns, or operates a scrap tire facility.
(B)
In addition to
the rules specified in paragraph (A) of this rule, this chapter is applicable
as follows:
(1)
Rules
3745-580-100 to
3745-580-125 of the
Administrative Code are applicable to any person who transports scrap
tires.
(2)
Rules
3745-580-200 to
3745-580-225 of the
Administrative Code are applicable to an owner or operator of a scrap tire
collection facility.
(3)
Rules
3745-580-300 to
3745-580-325 of the
Administrative Code are applicable to an owner or operator of a scrap tire
storage facility.
(4)
Rules
3745-580-400 to
3745-580-425 of the
Administrative Code are applicable to an owner or operator of a scrap tire
recovery facility.
(5)
Rules
3745-580-500 to
3745-580-525 of the
Administrative Code are applicable to an owner or operator of a mobile scrap
tire recovery facility.
(6)
Rule
3745-580-600 of the
Administrative Code is applicable to an owner or operator of a scrap tire
monocell facility.
(7)
Rules
3745-580-700 to
3745-580-726 of the
Administrative Code are applicable to an owner or operator of a scrap tire
monofill facility.
(8)
Rules
3745-580-800 to
3745-580-810 of the
Administrative Code are applicable to a person authorized to beneficially use
scrap tires.
(C)
In addition to the multi-program rules made applicable
by reference in this chapter, the following multi-program rules apply to this
chapter:
(1)
Rule
3745-500-35 of the
Administrative Code, which pertains to relationships among authorizing
documents, rules, and the authority of the director and board of
health.
(2)
Rule
3745-500-130 of the
Administrative Code, which pertains to retention and distribution of
authorizing documents.
(D)
This chapter does
not apply to the storage of one hundred or fewer scrap tires unless they are
stored in such a manner that, in the judgment of the director or the approved
board of health, causes a nuisance, a hazard to public health or safety, or a
fire hazard.
