Or. Admin. Code § 632-033-0050 - Appeals
(1) Prior to the
initiation of an appeal of any departmental order pursuant to the Mined Land
Reclamation Act or these rules the applicant or permittee shall first request
that the State Geologist informally review and resolve the matter. The State
Geologist shall provide a written decision within 20 days of receipt of such a
request. Thereafter, the applicant or permittee may request a contested case
hearing as provided in ORS
183.310-183.550.
(2) An applicant or permittee requesting a
contested case hearing shall state the reasons for requesting the hearing and
the objections to the department's order in accordance with ORS Chapter 183 and
the Attorney General's Model Rules of Procedure.
