58 Pa. Code § 63.17 - Importation and sale of hard clams
(a)
Except as otherwise provided in subsection (b), it is unlawful for a person to
possess, import into this Commonwealth, sell, offer for sale or purchase a hard
clam (mercenaria species) measuring less than 1 inch in
thickness.
(b) The size (thickness)
limit in subsection (a) does not apply to hard clams cultured by a clam
hatchery or clam aquaculture operation, if the origin of the cultured clams is
documented that permits immediate determination of the point of origin and the
ultimate destination. The documentation will include, at a minimum, a bill of
lading or bill of sale stating the origin of the clams and a signed
certification from the clam hatchery or clam aquaculture operation identifying
the volume or number of the clams in the shipment. The documentation required
by this subsection shall be displayed upon request to officers authorized to
enforce the code and this part.
