Utah Admin. Code R23-24-3 - Background
(1) The division is
charged with the responsibility of administering the design and construction of
capital facilities costing over $100,000 for all state agencies and
institutions regardless of funding source. The only exception to the division's
administration is when a project is delegated to an agency or institution by
the division or when the division authorizes a facility owner who will own,
operate, and maintain a facility located on state property to administer design
and construction of the facility.
(2) When projects are funded through
Legislative appropriation, the funding is generally made available to the
division before entering into contracts on those funds. However, many projects
receive all or a part of their funding from other sources. Examples of these
sources include donations, auxiliary funds, discretionary funds, reimbursed
overhead, revenue bonds, and federal funds. In addition, some projects are made
as a joint effort between state agencies or institutions and local governmental
units. In these situations, the division needs to receive adequate assurance
that the funding is in fact in place and that it will be reimbursed for
expenditures as they are made.
